These Terms & Conditions (“Terms”) govern your use of secretpleasurez.com (the “Site”) and any order you place through it. The Site, Secret Pleasurez, is operated by Secret Pleasurez Ltd Liability Co, a subsidiary of BlackGlass Tech Holdings LLC (“we,” “us” or “our”). By using the Site or placing an order, you agree to these Terms, our Privacy Policy and our Shipping & Returns policy, which are all part of this agreement. If you do not agree, please do not use the Site.
1. Adults only
This Site contains sexually oriented products and images and is for adults only. You must be at least 18 years old, or older if the age of majority where you live is higher, to use the Site or buy from it. If you are under that age, or if you are offended by sexually oriented products or images in any way, you must leave the Site immediately. By entering the Site and placing an order, you confirm that you are of legal age where you live and that you are buying for yourself or for another adult.
2. Your account
You can browse without an account. If you create one, give us accurate information, keep your password confidential and tell us promptly if you suspect unauthorized use. You are responsible for activity under your account. We may suspend or close an account that violates these Terms or that we reasonably believe is being used fraudulently.
3. Products and product information
We try to describe and photograph products accurately, but descriptions, images, colors, sizes, materials and specifications come from manufacturers and may differ slightly from what you receive. Manufacturer packaging and instructions control. Our products are sold for adult personal use, and we do not make medical claims about any product. Follow the manufacturer’s instructions for use, cleaning and storage, do not share personal items, and stop using a product and seek medical advice if it causes irritation or pain.
4. Prices, availability and promotions
Prices are in U.S. dollars and may change without notice. The price shown when you place your order applies to that order. Shipping and sales tax are added at checkout where applicable. Availability can change at any time; see Shipping & Returns for what happens if an item is unavailable.
We work to keep our listings accurate, but errors happen. If a product is listed at the wrong price or with wrong information, we may correct the listing, cancel the order or the affected items, and refund you in full. Some manufacturers restrict how their products can be discounted, so some promotions, coupon codes or free-shipping offers may not apply to certain brands or products. Offers cannot be combined unless stated, and we may end them at any time.
5. Orders and payment
When you place an order, you are making an offer to buy. Our order confirmation email means we have received your order, not that we have accepted it; we accept your order when it ships.
We may refuse, limit or cancel an order, before or after payment, if: an item is unavailable or mispriced; the delivery address is somewhere we cannot lawfully or practically ship; we suspect fraud, an unauthorized payment, or that the order is for resale; the information you gave is incomplete or inaccurate; or we cannot confirm that you meet the age requirement. If we cancel a paid order, we will refund what you paid for it.
You must use a payment method that you are authorized to use. Payments are handled by our third-party payment processor, and we do not store your full card number. If you have a problem with a charge, please contact us first so we can fix it quickly.
How the charge appears on your statement: for your privacy, your purchase appears discreetly on your card statement as SPZ_Ltd. Our store name and product names never appear on your statement.
6. Shipping, delivery and risk of loss
We ship within the United States as described in Shipping & Returns. Your order is packed and shipped for us by a fulfillment partner. Delivery dates are estimates, not guarantees. Title and risk of loss pass to you when the carrier delivers your package to the address you gave us. Packages are normally left without a signature. If a package is lost in transit, or shows as delivered but you did not receive it, see Shipping & Returns for what we will do.
7. All sales final; returns and refunds
Because of the personal nature of our products, all sales are final. We do not accept returns or exchanges, and we do not give refunds for a change of mind. If an item is defective or damaged, the wrong item is sent, or a package is lost in transit, contact us within 30 days of delivery and we will replace or refund it as described in Shipping & Returns. Please do not send anything back without our written authorization; unauthorized returns are discarded and not refunded.
8. Local laws and restricted areas
Laws about adult products differ from place to place. You are responsible for knowing and following the laws that apply to you where you live and where your order is delivered, and you must not order if it is unlawful for you to buy, possess or receive the products. We will not knowingly ship to a place where doing so is unlawful, and we may cancel and refund an order that we cannot ship. We are not responsible for a package that is held, seized, confiscated or destroyed by government authorities.
9. Acceptable use
When you use the Site, you agree not to: break the law or violate anyone’s rights; give us false, misleading or fraudulent information, or use someone else’s payment method or identity; submit content that is unlawful, harassing or hateful, that depicts anyone under 18, or that infringes anyone’s intellectual property; scrape, copy or harvest the Site’s content or data with automated tools; or probe, disrupt or bypass the Site’s security or its age screen.
10. Reviews and content you submit
If you post a review or other content on the Site, you confirm that it is your own honest opinion and experience. You keep ownership of it, and you give us a non-exclusive, worldwide, royalty-free license to display, reproduce and adapt it on the Site and in promotion of the Site. Do not post anyone’s personal information, including your own address or phone number. We may edit or remove content that breaks these Terms or that we consider inappropriate. We do not publish fake reviews, and we ask you not to submit one.
11. Intellectual property
The Site and its content (text, logos, graphics and design) belong to us or our licensors and are protected by law. Product names, brand names and product images belong to their respective owners. You may view and print pages for your own personal use; you may not copy, modify, distribute or use the Site’s content commercially without our written permission.
12. Warranties
Many products carry a manufacturer’s warranty; check the packaging. Apart from the remedies described in Shipping & Returns and any manufacturer’s warranty, we make no other express warranties about products. To the fullest extent permitted by law, any implied warranties on products, including the implied warranties of merchantability and fitness for a particular purpose, are limited to 30 days from delivery. This section does not affect any right the law gives you that cannot be waived.
13. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, arising from your use of the Site or the products, and our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits liability that the law does not allow to be limited, including liability for personal injury caused by a defective product, or any right you have under applicable consumer-protection law.
14. Governing law and disputes
These Terms, and any dispute relating to the Site or your orders, are governed by the laws of the State of Wyoming and applicable federal law, without regard to conflict-of-law rules. Before starting any legal proceeding, please contact us so we can try to resolve the problem informally. Subject to any right the law gives you to bring a claim in another court, disputes will be heard in the state or federal courts located in Wyoming.
15. Changes to these Terms
We may update these Terms from time to time. The version posted on the Site when you place an order applies to that order. Changes take effect when posted, and the “Last updated” date above shows when. If you keep using the Site after a change, you accept the updated Terms.
16. General
These Terms, together with our Privacy Policy and Shipping & Returns policy, are the entire agreement between you and us about the Site and your orders. If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a provision, that is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours as part of a sale of our business. You agree that we can communicate with you electronically, including by email, and that electronic notices satisfy any legal requirement that a notice be in writing.
